These Terms of Service ("Terms") govern your use of the Merch Legion platform ("Service") operated by Merch Legion ("we", "our", "us"). By using the Service, you agree to these Terms.

1. Service Description

Merch Legion is a print-on-demand management platform that provides tools for design creation, listing optimization, platform publishing, niche research, and sales tracking. The Service automates interactions with third-party platforms such as Amazon Merch on Demand.

2. Account Requirements

  • You must be at least 18 years old to use the Service
  • You must provide accurate account information
  • You are responsible for maintaining the security of your account credentials
  • You are responsible for all activity that occurs under your account
  • You must have valid accounts on any third-party platforms you connect to Merch Legion

3. Acceptable Use

You agree not to:

  • Use the Service to infringe on intellectual property rights, trademarks, or copyrights
  • Upload designs containing content that violates third-party platform policies
  • Attempt to circumvent platform rate limits or abuse automation features
  • Share your account credentials with others
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Use the Service for any illegal purpose

4. Third-Party Platforms

  • Merch Legion integrates with third-party platforms (Amazon Merch on Demand, etc.) through browser automation
  • You must comply with the terms of service of each platform you use through Merch Legion
  • We are not responsible for changes to third-party platform policies, APIs, or interfaces
  • Platform account suspensions or bans resulting from your content or actions are your responsibility
  • We do not guarantee that automation will always function correctly due to platform changes

5. AI-Generated Content

  • Designs and text generated by AI tools within Merch Legion are provided as-is
  • You are responsible for reviewing AI-generated content for trademark violations, copyright issues, and platform policy compliance before publishing
  • AI-generated designs may occasionally produce content that resembles existing works; it is your responsibility to verify originality
  • We do not claim ownership of AI-generated content created through your use of the Service

6. Intellectual Property

  • You retain ownership of designs you create or upload to Merch Legion
  • You grant us a limited license to store, process, and display your designs as necessary to provide the Service
  • We retain ownership of the Merch Legion platform, code, and documentation

7. Payment and Subscription

  • Access to Merch Legion requires a paid subscription
  • Subscription fees are billed monthly or annually as selected
  • You may cancel your subscription at any time; access continues until the end of the billing period
  • Refunds are handled on a case-by-case basis
  • We reserve the right to change pricing with 30 days advance notice

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using Merch Legion, you consent to the collection and use of information as described therein.

9. Service Availability

  • We aim to maintain high availability but do not guarantee uninterrupted service
  • We may perform maintenance that temporarily affects availability
  • We are not liable for downtime caused by third-party services, hosting providers, or circumstances beyond our control

10. Limitation of Liability

  • The Service is provided "as is" without warranties of any kind
  • We are not liable for lost profits, lost sales, or indirect damages resulting from use of the Service
  • We are not liable for actions taken by third-party platforms on your accounts
  • Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim

11. Termination

  • You may terminate your account at any time by contacting us
  • We may terminate or suspend your account for violation of these Terms
  • Upon termination, your designs and data will be deleted within 30 days unless you request an export

12. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms. We will notify you of significant changes by email.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which Merch Legion operates. Any disputes will be resolved through binding arbitration.
